Data Breach Class Action

October 19, 2023 -- Attention: victims of the BHI Energy data breach.

Abington Cole + Ellery is investigating the recently announced BHI Energy data breach.

Around June 29, 2023, BHI discovered the encryption of data on its computer network by an unidentified entity. A comprehensive investigation revealed that an unauthorized individual had gained access to and downloaded BHI's business records. These records included files with personally identifiable information (PII) and protected health information (PHI) related to beneficiaries of BHI’s self-insured employer-sponsored health plan. After detecting the security breach, BHI neutralized the threat and contained the incident.

In addition to that, BHI informed both federal and local law enforcement agencies and engaged the services of a third-party cybersecurity firm to scrutinize the extent and nature of the security incident. This inquiry, which also entailed identifying the number of individuals whose PII and/or PHI could have been exposed, mostly wrapped up by September 1, 2023. Starting approximately on October 18, 2023, BHI began mailing notifications to the impacted individuals.

Since the initial discovery, BHI claims it has been actively collaborating with both internal and external experts to bolster the security measures of its systems against external threats. Concurrently, BHI is reassessing its privacy and security protocols, procedures, and training in light of this incident.

As a result of the data breach, BHI Energy is offering 2 years of free credit monitoring and/or identity theft protection services to affected individuals.

Approximately 91,000 individuals were affected by the BHI Energy data breach.

Breached data may include, but is not necessarily limited to: name, Social Security number, date of birth, address, and medical and claims data.
